Obtaining Expungements and Other Judicial Relief

A felony or misdemeanor conviction will remain on your record forever unless you take steps to expunge it. Expungements remove prior convictions from your record and therefore take away obstacles to employment, housing, and other legal benefits. Not every conviction is expugnable. Our attorneys will file a motion with the court where your conviction took place. The probation office will review your motion and offer a report to the court about your request. If granted, the court will set aside your conviction, enter a plea of not guilty plea, and dismiss the charge against you. The court will alter your record with the Department of Justice, and your conviction will be expunged.

Misdemeanor Expungements

You can expunge most misdemeanor convictions after you successfully completed probation. If convicted of a misdemeanor but not sentenced to probation, you may expunge your record after one year has past since your conviction. We can petition the court to expunge your record even if you violated the terms of probation and later successfully complied with those terms.

Felony Expungements

Depending on the circumstances of your case, a felony may still be expunged. Given the serious nature of felonies, courts take a harder look at the circumstances of the case. If sentenced to probation instead of prison, you have a better chance to expunge your record. Many times, given the facts of the case, the prosecutor could charge an offense as a misdemeanor or a felony. If your conviction could arguably have been a misdemeanor, you may have a better chance of expunging your record.
